Subject: [FFmpeg-devel] Defamation
Date: Thu, 22 May 2025 20:56:18 +0000
Message-ID: <DM8P223MB03654F941A7EB4C6D7596F37BA99A@DM8P223MB0365.NAMP223.PROD.OUTLOOK.COM> (raw)

Defamation is a false statement of fact that harms a person's reputation.
It can be either libel (written) or slander (spoken). In essence,
defamation is a civil wrong (a tort) that provides a remedy for individuals
who have suffered harm to their reputation due to false statements made
about them to a third party.

Key Elements of Defamation
==========================

- False Statement of Fact
The statement must be untrue and presented as a fact.

- Harm to Reputation
The statement must cause actual damage to the person's reputation or
cause them to suffer special damages.

- Publication
The statement must be communicated to a third party (someone other
  than the person defamed).

- Fault
The defendant must have been negligent or malicious in publishing
  the statement.

---------------------

You can argue with me, you can criticize me specifically, you can annoy
me, you can disagree with me, you can bore me, you can legitimately
blame me, you can laugh about me, you can talk about me, you can offend
me, you can even insult me and a lot more. But nobody shall make untrue
statements about me and my work.

---------------------

Today, I've moved the situation to a point where it has become so
clearly visible like never before on this mailing list.

There's a point where Opinion ends and Defamation begins.

Some people should take a moment and think about this.
